Automatic Expungement of a Cannabis Offense
Starting August 1, 2023, Minnesotans with cannabis offenses on their criminal record can ask for automatic expungements. This removes the offenses from your criminal record. There is a form to submit. There is no filing fee and there is NO hearing.
If the court approves your request, an expungement order is sent:
- to you,
- the Minnesota Bureau of Criminal Apprehension (BCA),
- the law enforcement agency that cited or arrested you, and
- the prosecutor on your case.
If the court denies your request, a copy of the denial order is sent to you and to the prosecutor.
