I am being evicted. Do I qualify for a court-appointed attorney?
As of August 1, 2023, tenants in certain housing cases may qualify for a right to court-appointed counsel. To qualify:
- The person is a defendant/tenant in an eviction action,
- The property at issue is public housing (rental housing operated by or paid for by a Public Housing Authority. This is not a private landlord or Section 8 housing.),
- The eviction complaint alleges breach of lease, AND
- The tenant is financially unable to obtain private counsel.
NOTE: A simple non-payment of rent case does not qualify.
